Terms of Service

Welcome to FriendsTapes (the “Service,” “we,” “our,” or “us”). These Terms of Service (“Terms”) govern your access to and use of the FriendsTapes website and any related applications, features, and services. By accessing or using any part of the Service, you agree to be bound by these Terms. If you do not agree, you may not use the Service.

1. Acceptance of Terms

By creating an account or otherwise using the Service, you acknowledge that you have read, understood, and agree to these Terms, as well as our Privacy Policy. If you do not agree with any part of these Terms, you must discontinue use of the Service immediately.

2. Eligibility

You must be at least the age of majority in your jurisdiction to use the Service. By using the Service, you represent and warrant that:

You have the right, authority, and capacity to enter into a legally binding agreement.
All information you submit is truthful and accurate.
Your use of the Service will comply with all applicable laws and regulations.

 

3. Description of the Service

FriendsTapes allows you to:

  1. Subscribe to Artist Notifications via Email: You can enter an artist’s name and your email address to receive email notifications when the artist releases new music.

  2. Optional Spotify Integration: You may link your Spotify account (via Spotify’s OAuth) to browse and select artists from your library to subscribe. This is optional; you do not need to log in with Spotify to receive notifications.

  3. No traditional password-based account is required. Instead, we verify your email address once to ensure it is valid. After that, we store your email-and-artist subscription data to provide notifications about new music releases.

4. Email Verification and Subscription

  1. Email Verification: When you first subscribe to notifications, you must verify your email by clicking on a confirmation link or taking similar steps. This helps us ensure the email address is valid and that the owner of the email has consented to receive notifications.

  2. Email–Artist Relationship: We keep a record of which email addresses have subscribed to which artists. This data is used solely for the purpose of sending relevant notifications.

  3. Unsubscribe Mechanism: Each email notification includes a link to unsubscribe from that particular artist’s notifications. This link uses a JWE (JSON Web Encryption) token that securely identifies your subscription without requiring a password or separate login.

5. Spotify Integration and User Responsibilities (Optional)

By connecting your Spotify account, you consent to our use of your Spotify data as outlined in our Privacy Policy. You retain the right to disconnect your Spotify account at any time.

How to Disconnect Your Spotify Account:

  • A "Disconnect" button is available in your user interface at https://spotify.friendstapes.com/subscribe at the top right corner, which allows you to revoke our access to your Spotify account. Upon disconnection:

    1. Your Spotify Personal Data will no longer be accessed or processed by our Service.

    2. Any artist subscriptions linked to your Spotify account will be disabled.

    3. We will delete any stored Spotify data in compliance with Spotify’s Developer Terms.

By disconnecting, you acknowledge that any further use of the Service will require reconnecting your Spotify account or manually entering your email and artist preferences.

6. Use of Spotify Data (Optional)

  1. OAuth Integration: If you choose to connect your Spotify account, we may request certain permissions (scopes) from Spotify, such as access to your liked tracks, followed artists, or playlists.

  2. Data Usage: We use this data to help you easily subscribe to the artists you already follow in Spotify. We do not store or use your Spotify credentials; the authorization is handled by Spotify’s OAuth, and we only receive the data you explicitly approve.

  3. No Affiliation with Spotify: FriendsTapes is not affiliated, endorsed, or sponsored by Spotify. Spotify is a registered trademark of Spotify AB, and your use of Spotify is governed by Spotify’s own Terms and Privacy Policy.

7. Data Collection and Privacy

We respect your privacy. Please read our Privacy Policy to understand how we collect, use, and safeguard your personal data, including the email address and any artist-related preferences you provide. By using the Service, you consent to our collection and use of your information as described in the Privacy Policy.

8 User Obligations and Conduct

You agree that you will not:

  1. Use the Service for any unlawful purpose or in violation of any applicable laws.

  2. Interfere with or disrupt the operation of the Service or servers or networks connected to the Service.

  3. Use any automated system, software, or device to access the Service for data scraping or similar purposes without our prior written permission.

  4. Collect or store personal data about other users without their explicit consent.

  5. Violate any intellectual property rights or any other rights of anyone else.


9. Intellectual Property Rights

  1. Service Content: Unless otherwise indicated, all content, information, and other materials on the Service are the property of FriendsTapes or our licensors and are protected by intellectual property laws.

  2. License: We grant you a limited, non-exclusive, non-transferable, and revocable license to access and use the Service for personal, non-commercial purposes, subject to these Terms.

  3. Trademarks: All trademarks, logos, and service marks displayed on the Service are our property or the property of other third parties. You are not permitted to use them without our prior written consent or the consent of such third party.

10. Email Communications and Notifications

  1. Opt-In: By providing your email address, you consent to receive notifications regarding new music releases from the artists you have subscribed to, as well as administrative or service-related messages.

  2. Opt-Out: You may unsubscribe from artist notifications at any time by following the unsubscribe link included in each email. Some administrative emails (e.g., verification requests) may still be sent if needed to operate the Service.

11. Third-Party Services

  1. Spotify: If you choose to connect your Spotify account, you are subject to Spotify’s Terms of Use and Privacy Policy. FriendsTapes is not responsible for your experience on Spotify’s platform.

  2. External Links: The Service may contain links to third-party websites, services, or offers. We do not control or endorse these third parties and assume no responsibility for their content or privacy practices.


12. Disclaimer of Warranties

To the fullest extent permitted by law, the Service is provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied. We do not warrant that:

  1. The Service will meet your specific requirements.

  2. The Service will be uninterrupted, timely, secure, or error-free.

  3. The information or results obtained from the Service will be accurate or reliable.

13. Limitation of Liability

To the maximum extent permitted by law, in no event shall FriendsTapes or its directors, employees, or agents be liable for any indirect, incidental, special, or consequential damages arising out of or in connection with your use or inability to use the Service. In no event shall our total liability to you exceed the amount paid by you (if any) for accessing or using the Service during the twelve (12) months preceding the event giving rise to the claim.

14. Indemnification

You agree to defend, indemnify, and hold harmless FriendsTapes and its affiliates, and their respective officers, directors, employees, and agents, from and against any and all claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or in any way connected with:

  1. Your access to or use of the Service.

  2. Your violation of these Terms.

  3. Your violation of any third-party rights, including intellectual property or privacy rights.


15. Termination

We reserve the right to suspend or terminate your access to the Service at any time, for any reason or no reason, including if you violate these Terms. Upon termination, all licenses and other rights granted to you in these Terms will immediately cease.

16. Governing Law and Dispute Resolution

These Terms and any dispute arising out of or related to these Terms or the Service will be governed by the laws of the United States, without regard to conflict of law provisions. Any legal suit, action, or proceeding arising out of or related to these Terms shall be instituted exclusively in the courts of the United States.

17. Changes to the Terms

We may update these Terms from time to time. If we make material changes, we will notify you by posting the updated Terms on our website and indicating the “Last Updated” date. Your continued use of the Service after the effective date of the updated Terms constitutes your acceptance of the changes.
